This is the second of two interlinked articles in which the Swedish Social Insurance Agency’s handling of and decision-making in occupational injury cases are studied from a socio-legal perspective. The previous part I covered the agency’s duty of investigation. In this subsequent part II, the focus is shifted to the agency’s assessment of evidence in occupational injury cases.
Our case study shows that the Swedish Social Insurance Agency does not always assess the evidence properly in occupational injury cases, e.g. by using incorrect standards of proof to the detriment of the individual. However, our study has not shown any differences related to gender in the agency’s assessment of evidence. The errors and shortcomings that have been noted are indeed troublesome, but do not seem to be discriminatory.
